How Long Does A Chapter 13 Bankruptcy Last?

A chapter 13 bankruptcy is often called a reorganization in its simplest terms. It is also called a wage earner’s plan since it enables individuals with regular income to develop a plan to repay all or part of their debts over three to five years. Creditors are prohibited from starting or continuing collection efforts during this three to five year period.

If a debtor’s current monthly income is less than the Utah median, the debtor must propose a three-year plan unless the court approves a longer period “for cause.” If the debtor’s current monthly income is greater than the applicable Utah state median, the debtor must propose a five-year plan. In no case may a plan provide for payments over a period longer than five years.

Chapter 13 bankruptcy allows debtors to reorganize their debts, cure delinquent mortgage or auto loan payments, and pay nondischargeable priority obligations in full through a repayment plan. While this repayment plan is limited to a three to five year period, the length of a Chapter 13 plan depends on income, and the amount of time needed to repay the debts included in a Chapter 13 plan.
